Terms of Service

By creating an account, accessing, or using the Skin Voyager App or website at www.skinvoyager.com (together, the "Service"), you confirm that:

• You are at least 18 years of age (or the age of majority in your jurisdiction, whichever is higher);
• You have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated here by reference;
• If you are accepting these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind that entity.

If you are under 18, you may only use the Service with the verified consent of a parent or legal guardian, who agrees to these Terms on your behalf and accepts full responsibility for your use.

These Terms apply to users in the United States and Canada. By using the Service, you represent that you are located in one of these countries or that you otherwise comply with all applicable local laws in your jurisdiction.

What Skin Voyager Does

Skin Voyager is an AI-powered skincare analysis application available on the Apple App Store and Google Play. The App uses your device's camera to perform a facial scan and analyzes up to 40 skin biomarkers — including hydration levels, texture, tone evenness, pore appearance, fine lines, and pigmentation indicators — to generate personalized skincare insights and product recommendations.

What Skin Voyager Is Not

The App's AI models are trained on cosmetic and skincare data. They are not cleared or approved by the U.S. Food and Drug Administration (FDA), Health Canada, or any other regulatory body as a medical device or clinical diagnostic tool.

Service Availability

We aim to keep the Service available at all times but do not guarantee uninterrupted access. We may suspend or modify the Service for maintenance, updates, or circumstances beyond our reasonable control. We will make reasonable efforts to provide advance notice of planned downtime.

Account Registration

To access the full features of the Service, you must create an account. When registering, you agree to provide accurate, current, and complete information and to keep it updated. You may register using your email address or through a supported third-party sign-in provider (such as Sign in with Apple or Google).

Account Security

You are responsible for maintaining the confidentiality of your login credentials. You agree to:

• Choose a strong, unique password and not share it with anyone;
• Notify us immediately at hello@skinvoyager.com if you suspect unauthorized access to your account;
• Accept responsibility for all activity that occurs under your account, whether or not authorized by you.

One Account Per Person

Each person may maintain only one Skin Voyager account. Accounts are personal and non-transferable. You may not create an account on behalf of another person without their knowledge and consent.

Account Termination by You

You may delete your account at any time from the App's settings menu or by contacting us. Deletion is subject to our data retention practices described in the Privacy Policy. Active subscription obligations are not automatically cancelled upon account deletion — you must cancel your subscription separately through the App Store or Google Play before deleting your account.

Account Suspension or Termination by Us

We reserve the right to suspend or permanently terminate your account, without prior notice, if we reasonably believe you have violated these Terms, engaged in fraudulent activity, or pose a risk to other users or the integrity of the Service. If your account is terminated for cause, you will not be entitled to a refund of any unused subscription period.

Subscription Plans

Skin Voyager offers the following paid subscription tiers, with current pricing displayed in the App at the time of purchase:

• Monthly Plan: Billed once per month on the anniversary of your subscription start date.
• Annual Plan: Billed once per year on the anniversary of your subscription start date. Annual plans are offered at a discounted effective monthly rate compared to the monthly plan.

A limited free tier may be available with restricted features. We reserve the right to modify, discontinue, or change the features included in any tier at any time with reasonable notice.

Billing & Payment Processing

All payments are processed exclusively through the Apple App Store (for iOS users) or Google Play (for Android users). We do not directly collect or store your payment card information. All billing, invoicing, and payment disputes are governed by the terms of the applicable platform (Apple or Google). By subscribing, you also agree to the payment terms of the platform through which you purchase.

Auto-Renewal

Subscriptions automatically renew at the end of each billing period (monthly or annual) unless you cancel at least 24 hours before the renewal date. Renewal charges will be applied to your platform payment method at the then-current subscription price. You authorize this recurring charge by initiating a subscription.

We will provide advance notice of any price increases before they take effect on your renewal date. Continued use of the Service after a price change takes effect constitutes your acceptance of the new price.

Free Access

We offer a free tier: you can scan your skin without an account, and creating a free account unlocks your full 40-biomarker report. Personalized routines and product recommendations require a paid Premium subscription. Paid plans are one-time purchases for the stated period (weekly, monthly or annual) and do not auto-renew.

Cancellation Policy

You may cancel your subscription at any time through your App Store or Google Play account settings. Cancellation takes effect at the end of the current billing period — you will retain access to paid features until that date. Cancelling a subscription does not delete your account or your skin scan history.

To cancel on iOS: Go to Settings → [Your Name] → Subscriptions → Skin Voyager → Cancel.
To cancel on Android: Go to Google Play → Account → Subscriptions → Skin Voyager → Cancel.

Refund Policy

Because subscriptions are purchased through Apple or Google, all refund requests are subject to the refund policies of those platforms. Skin Voyager does not process refunds directly. To request a refund:

• Apple: Visit reportaproblem.apple.com.
• Google: Visit the Google Play Help Center or submit a request through your purchase history.

We will not issue additional refunds beyond what is required by applicable law or the platform's own policy.

Taxes

Subscription prices may be subject to applicable taxes (such as sales tax or GST/HST), which will be calculated and displayed at checkout by the applicable platform. You are responsible for any taxes applicable to your purchase.

Camera Permission

The core functionality of Skin Voyager requires access to your device's front-facing camera. When you initiate a facial scan, you grant the App permission to capture still images or short video frames solely for the purpose of performing the skin analysis. Camera access is used only when you actively initiate a scan — we do not access your camera in the background.

Facial Scan Images

Images captured during a facial scan are processed to extract skin biomarker data. Raw facial images may be temporarily retained on our secure servers for quality assurance and model improvement purposes, as described in our Privacy Policy. You can request deletion of your facial scan data at any time by contacting us.

Biometric Data & Applicable Law

Depending on your jurisdiction, data derived from facial scans — including facial geometry or skin feature measurements — may be classified as "biometric data" under applicable privacy laws (such as the Illinois Biometric Information Privacy Act, Texas Capture or Use of Biometric Identifier Act, or similar state laws, as well as Canadian provincial privacy legislation). We handle such data in accordance with our Privacy Policy and applicable law, including:

• Obtaining your explicit consent before collecting biometric data where required;
• Using biometric data only for the purposes described in these Terms and our Privacy Policy;
• Not selling biometric data to third parties;
• Implementing reasonable security measures to protect biometric data from unauthorized access.

By using the scan feature, you consent to our collection and processing of your facial scan data as described in these Terms and our Privacy Policy.

No Sharing of Biometric Data for Advertising

We do not use your facial scan data, skin biomarker measurements, or any derived biometric identifiers for targeted advertising, sale to data brokers, or any purpose unrelated to providing the Service.

Our Property

The Skin Voyager App, website, and all content, features, and functionality therein — including but not limited to the AI analysis engine, software code, algorithms, UI/UX design, text, graphics, logos, and trademarks — are owned by Skin Voyager, Inc. and protected by copyright, trademark, trade secret, patent, and other intellectual property laws of the United States and Canada.

These Terms do not transfer any ownership rights to you. You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial purposes during the term of your account.

Your Content

You retain ownership of any content you submit to the Service (such as profile photos or written skin notes). By submitting content, you grant Skin Voyager a worldwide, royalty-free, sublicensable license to use, store, display, and process that content solely to provide and improve the Service.

Feedback

If you provide us with feedback, suggestions, or ideas about the Service ("Feedback"), you agree that we may use such Feedback freely and without any obligation or compensation to you. Feedback is not considered confidential.

Third-Party Components

The App may incorporate third-party software libraries, APIs, and components, each governed by their own licenses. We comply with all applicable open-source and third-party license requirements.

You agree not to use the Service to:

• Diagnose, treat, cure, or prevent any medical condition or disease;
• Reverse-engineer, decompile, disassemble, or attempt to extract the source code of the App;
• Copy, reproduce, distribute, or create derivative works of any part of the Service without our written permission;
• Scrape, crawl, or use automated means to access the Service or extract data from it;
• Impersonate any person or entity, or falsely represent your affiliation with any person or entity;
• Upload or transmit viruses, malware, or any code designed to disrupt, damage, or gain unauthorized access to systems;
• Use the Service for any unlawful purpose or in violation of any applicable law or regulation;
• Harass, intimidate, or harm other users;
• Attempt to gain unauthorized access to any portion of the Service, its servers, or any network connected to it;
• Use the Service to conduct competitive intelligence or benchmarking without our prior written consent;
• Sublicense, resell, or otherwise commercialize the Service or your access to it;
• Circumvent or disable any security, access-control, or subscription-enforcement features.

Violation of these restrictions may result in immediate termination of your account and, where appropriate, referral to law enforcement authorities.

No Doctor-Patient Relationship

Use of the Service does not create a doctor-patient relationship, a healthcare provider-patient relationship, or any other professional relationship between you and Skin Voyager or any of its employees, contractors, or AI systems.

Accuracy of AI Analysis

The AI analysis engine is based on statistical models trained on cosmetic datasets. Results may vary significantly based on lighting conditions, camera quality, skin tone, facial hair, makeup, and other factors. Skin Voyager does not warrant that the biomarker readings, scores, or recommendations are accurate, complete, or suitable for any particular individual.

"As-Is" Service

The Service is provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied. To the fullest extent permitted by applicable law, we disclaim all warranties, including but not limited to:

• Implied warranties of merchantability, fitness for a particular purpose, and non-infringement;
• Any warranty that the Service will be uninterrupted, error-free, or free from harmful components;
• Any warranty regarding the accuracy, reliability, or completeness of any content or analysis provided by the Service.

Third-Party Products

Skin Voyager may recommend third-party skincare products. We do not manufacture, endorse, or guarantee any recommended product. Product recommendations are generated algorithmically and do not constitute a paid endorsement unless expressly disclosed. We are not responsible for any adverse reactions, injuries, or damages arising from the use of any recommended product.

To the fullest extent permitted by applicable law:

Exclusion of Consequential Damages

Skin Voyager, its officers, directors, employees, affiliates, agents, and licensors will not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages arising out of or related to your use of (or inability to use) the Service. This includes, without limitation, damages for loss of data, loss of revenue, loss of profit, goodwill, or other intangible losses — even if we have been advised of the possibility of such damages.

Cap on Liability

Our total aggregate liability to you for any claims arising out of or related to these Terms or the Service, regardless of the form of action, will not exceed the greater of: (a) the total subscription fees you paid to us in the twelve (12) months immediately preceding the event giving rise to the claim, or (b) one hundred U.S. dollars (USD $100).

Medical Decisions

Under no circumstances will Skin Voyager be liable for any harm, injury, illness, or adverse outcome resulting from your reliance on the App's analysis in lieu of professional medical or dermatological care.

Jurisdictional Exceptions

Some jurisdictions — including certain Canadian provinces — do not allow the exclusion or limitation of certain implied warranties or liability for consequential damages. If you are located in such a jurisdiction, some of the above limitations may not apply to you. In those cases, our liability will be limited to the greatest extent permitted by applicable law.

Indemnification

You agree to defend, indemnify, and hold harmless Skin Voyager and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the Service in violation of these Terms; (b) any content you submit; or (c) your violation of any applicable law or the rights of any third party.

Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict-of-law provisions. If you are located in Canada, mandatory consumer protection laws of your province may also apply to you and cannot be waived by contract.

Informal Resolution First

Before initiating any formal dispute, you agree to contact us at hello@skinvoyager.com and give us 30 days to attempt to resolve the issue informally. Most concerns can be resolved quickly through direct communication.

Binding Arbitration (U.S. Users)

For users located in the United States, any dispute, claim, or controversy arising out of or relating to these Terms or the Service that cannot be resolved informally will be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration will take place on an individual basis — class actions and class arbitrations are not permitted.

You may opt out of the arbitration agreement by sending written notice to hello@skinvoyager.com within 30 days of first agreeing to these Terms. If you opt out, disputes will be resolved in the courts specified below.

Jurisdiction for Court Actions

To the extent any dispute proceeds in court (including if you opt out of arbitration), you and Skin Voyager consent to exclusive jurisdiction and venue in the state and federal courts located in Wilmington, Delaware, USA. You waive any objection to venue or personal jurisdiction in those courts.

Canadian Users

Users in Canada may have additional rights under provincial consumer protection legislation. Nothing in these Terms limits any rights you have under applicable Canadian law that cannot legally be contracted out of.

Time Limit on Claims

Any claim or cause of action arising out of or related to these Terms or the Service must be filed within one (1) year after such claim or cause of action arose, or it will be permanently barred, to the maximum extent permitted by law.

We may update these Terms from time to time. When we do, we will:

• Post the revised Terms in the App and on our website at www.skinvoyager.com/terms;
• Update the "Last Updated" date at the top of this document;
• Send you an in-app notification or email if the changes are material.

Your continued use of the Service after the effective date of revised Terms constitutes your acceptance of the changes. If you do not agree to the revised Terms, you must stop using the Service and cancel any active subscription before the changes take effect.

For material changes — such as modifications to the arbitration clause, data practices, or subscription pricing — we will provide at least 30 days' advance notice before the new Terms take effect.
